These Terms of Service ("Terms") govern your use of ClaimPass. Please read them carefully. If you do not agree, do not use the service.
1. Acceptance of Terms
By accessing or using ClaimPass, you agree to be bound by these Terms and our Privacy Policy. You must be at least 18 years old to create an account or use the service. If you are using ClaimPass on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
ClaimPass provides insurance adjuster exam preparation tools, including a question bank and an AI-powered study assistant.
ClaimPass is an educational tool. We do not guarantee that using ClaimPass will result in passing any licensing exam, and we are not a substitute for legal, professional, regulatory, or insurance advice.
3. AI and Practice Content Disclaimer
ClaimPass uses generative AI to produce responses, explanations, and practice scenarios. AI output can be incomplete, outdated, or factually wrong. Always verify information against official sources before relying on it.
Practice questions are study aids only. They are not actual exam questions and their answers are not authoritative legal interpretations. Verify all statute references at oregonlegislature.gov before your exam.
ClaimPass is an independent product. We are not affiliated with PSI, the Oregon Division of Financial Regulation, or any other licensing body or examination vendor.
4. Subscriptions and Billing
Paid subscriptions are billed monthly and renew automatically until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
We do not provide refunds for partial billing periods or for periods of non-use. We may change prices with at least 30 days' notice; continued use after a price change takes effect constitutes acceptance of the new pricing.
5. Account Responsibilities
You are responsible for keeping your credentials secure and for all activity under your account. Accounts are personal — one account per person. You may not share your account, sell access to it, or use it on behalf of multiple users.
6. Intellectual Property
All ClaimPass content — including question banks, explanations, copy, design, and software — is the proprietary work of ClaimPass and its licensors. You may use the service for your own personal exam preparation. You may not reproduce, redistribute, scrape, resell, or create derivative works from ClaimPass content without our prior written permission.
7. Limitation of Liability
ClaimPass is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that it will produce any particular result, including a passing exam score.
To the fullest extent permitted by law, ClaimPass and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the three months preceding the event giving rise to the claim.
8. Termination
We may suspend or terminate your account if you violate these Terms or use the service in a way that causes harm to us or other users. You may cancel your account at any time. On termination, your right to use the service ends immediately.
9. Governing Law
These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of laws principles. Disputes will be resolved in the state or federal courts located in Oregon.
